Your marriage is over and you want your divorce, now. You have kids .
The marriage may be dead, but even though you will soon be considered legally single, you will continue being a parent. As a parent, you have rights and obligations vis-à-vis your kids. You must be sensitive to the needs of your kids in what surely will be a time of inner turmoil and uncertainty. By law, both parents must take an approved parenting class without delay. The class will sensitize you to the kids' issues you need to resolve and will get you focused. Taking it may save you all unnecessary pain and heartache. If you are even thinking about getting divorced and you have kids, we recommend that you take the course now (online or correspondence classes are available for around $40). It's not about trying to talk you out of getting divorced, but rather, about making the transition a smooth one.
No agreement you make with your spouse, today, regarding your kids, cannot be undone or modified by a judge, tomorrow, if the circumstances justify it. Until they reach the age of majority (18), either parent can ask for and a judge can make any order allowed by law, so long as it is in the best interests of the kids to do so.
These are the four areas you need to talk about and agree on :
1. Your stuff (dividing your property and debt, if any)
2. Alimony (is anyone getting spousal support?)
3. Raising the children and child sharing (visitation)
4. Child support and health care
Our lawyers are standing by to talk to you.
